Terms and Conditions for Curious Kids

4.1 Booking Process

You can book visits through:

• Our website (curiouskids.in)
• The Curious Kids mobile app
• By phone at +91- 08062985925
• Walk-in (subject to availability)

4.2 Booking Confirmation

All bookings are subject to availability. A booking is confirmed only when you receive a confirmation email or in-app notification with a booking reference number.

4.4 Cancellation and Refund Policy

Cancellations by You:

• More than 48 hours before visit: Full refund minus processing fee (5%)
• 24-48 hours before visit: 50% refund
• Less than 24 hours before visit: No refund
• No-show: No refund

Cancellations by Us:

• If we cancel your booking for any reason, you will receive a full refund within 7-10 business days
• We reserve the right to cancel bookings due to unforeseen circumstances, maintenance, or capacity limitations

Refund Processing: Refunds will be processed to the original payment method within 7-10 business days.

4.5 Rescheduling

You may reschedule your visit once without charge if done at least 48 hours in advance, subject to availability.

4.6 Birthday Parties and Group Bookings

Special terms apply to birthday party and school trip bookings:

• Custom cancellation policy applies (communicated at time of booking)
• Final guest count must be confirmed 48 hours before the event
• Additional charges apply for guests exceeding the booked count

5.4 No Refunds on Curios

Once purchased or loaded, Curios are non-refundable except in cases where we cancel your visit or deny entry for reasons attributable to us.

6.1 Stamps, Gems, and Badges

Children earn non-monetary rewards:

• Stamps: Collected in the Passport for zone exploration
• Gems: Awarded for winning competitions and completing challenges
• Badges: Physical recognition (pins/magnets) for milestones achieved
• Certifications: Card-sized stickers for completing skill training programs

6.2 Earning Rewards

Reward eligibility and earning criteria are determined solely by Curious Kids and may be modified at any time.

6.3 Digital Recognition

Children who earn Badges may be featured on our app and social media with their name, photo, and achievement (subject to parental consent as per Privacy Policy).

6.4 No Cash Value

Rewards have no monetary value and cannot be exchanged, transferred, or redeemed for cash.

7.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and website for personal, non-commercial purposes.

7.2 Prohibited Uses

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to hack, disrupt, or gain unauthorized access to our systems
• Upload viruses, malware, or harmful code
• Impersonate another person or entity
• Scrape, data mine, or harvest information from our Services
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) to access our Services
• Share your account credentials with others

7.3 User Content

If you submit reviews, testimonials, photos, or other content:

• You grant us a perpetual, royalty-free, worldwide license to use, display, and distribute such content
• You represent that you own or have rights to the content
• You agree not to submit content that is defamatory, offensive, or violates third-party rights

7.4 Intellectual Property

All content on the App and website-including text, graphics, logos, images, software, and the Curious Kids brand-is owned by us or our licensors and protected by intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.

8.1 Entry Requirements

• Children aged 2-5 years: Must be accompanied by one mandatory adult
• Children aged 6-13 years: One adult companion is optional
• All visitors must present valid booking confirmation at entry
• We reserve the right to deny entry if capacity is reached or for safety reasons

8.2 Safety Rules

For the safety of all participants:

• Follow all posted rules and staff instructions
• Wear appropriate clothing and closed-toe shoes
• Remove jewelry and accessories that may pose safety hazards
• Children with medical conditions must inform staff at check-in
• Supervisory adults are responsible for children's safety at all times

8.3 Prohibited Items

The following are not permitted in the Center:

• Outside food and beverages (except for dietary/medical needs with prior approval)
• Weapons or sharp objects
• Illegal substances
• Pets (except service animals)
• Smoking and alcohol

8.4 Code of Conduct

All visitors must:

• Treat staff, other children, and families with respect
• Not engage in bullying, harassment, or aggressive behavior
• Not damage or misuse Center property or equipment
• Follow hygiene standards (hand washing, cleanliness)

8.5 Consequences of Violations

Violation of Center rules may result in:

• Warning from staff
• Removal from the Center without refund
• Suspension or permanent ban from future visits
• Legal action for property damage or safety violations

8.6 Supervision of Children

• Toddlers (2-5 years) must have one mandatory adult present at all times
• Children aged 6-13 must be supervised per staff guidance
• Parents/guardians are responsible for their children's conduct
• We are not a childcare facility; adult supervision is required as specified

9.1 Medical Conditions

Parents must disclose any:

• Medical conditions (allergies, asthma, epilepsy, etc.)
• Physical limitations
• Dietary restrictions
• Medications the child may need during the visit

This information helps us provide appropriate care and make necessary accommodations.

9.2 Emergency Medical Treatment

In case of medical emergency:

• We will attempt to contact the parent/guardian immediately
• If we cannot reach you, we may seek emergency medical treatment for the child
• You authorize us to act in the child's best interest in emergency situations
• You are responsible for all medical costs incurred

9.3 Allergies and Dietary Requirements

We make reasonable efforts to accommodate dietary restrictions, but cannot guarantee an allergen-free environment. Parents are responsible for monitoring their child's food consumption.

9.4 Assumption of Risk

Physical activities involve inherent risks. By participating, you acknowledge:

• You understand the risks associated with activities
• Your child is physically capable of participating
• You assume all risks of injury or harm
• You waive claims against Curious Kids for injuries arising from normal participation (except in cases of our gross negligence)

10.1 Center Photography/Videography

We may capture photographs and videos during activities for:

• Marketing and promotional materials
• Social media content
• Website and app content
• Internal documentation

10.2 Consent and Opt-Out

By visiting the Center, you consent to photography/videography. You may opt-out at any time by:

• Notifying staff at check-in
• Emailing events@curiouskids.in
• Updating preferences in the app

10.3 Your Photography

Parents may take photos and videos of their own children for personal use. You may not:

• Photograph or record other children without parental consent
• Use photos/videos for commercial purposes
• Post images of other children on social media without permission

11.1 Payment Processors

We use third-party payment gateways (YPay). Their terms and privacy policies apply to payment transactions.

11.2 External Links

Our Services may contain links to third-party websites or services. We are not responsible for their content or practices. Use them at your own risk.

11.3 Social Media Integration

If you connect your account with social media platforms, their terms and privacy policies apply.

12.1 Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including:

• Fitness for a particular purpose
• Uninterrupted or error-free service
• Accuracy or reliability of content

12.2 Limitation of Liability

To the maximum extent permitted by law, Curious Kids shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Personal injury (except in cases of gross negligence or willful misconduct)
• Damage to property beyond the cost of your booking
• Claims arising from your violation of these Terms

12.3 Maximum Liability

Our total liability to you shall not exceed the amount you paid for the specific visit or booking that gave rise to the claim.

12.4 Indemnification

You agree to indemnify and hold harmless Curious Kids, its officers, employees, and affiliates from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your child's conduct at the Center
• Your violation of any third-party rights

13.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

13.2 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes through:

• Direct communication with our team at events@curiouskids.in
• Good faith negotiation for 30 days

13.3 Arbitration

If negotiation fails, disputes shall be resolved through binding arbitration in Bengaluru under the Indian Arbitration and Conciliation Act, 1996.

13.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

14.1 Ownership

All intellectual property related to Curious Kids-including trademarks, logos, designs, curriculum, activity concepts, the Curios currency system, and proprietary methods-are owned by us or our licensors.

14.2 Restrictions

You may not:

• Use our trademarks, logos, or branding without written permission
• Copy or replicate our business model or activities
• Create derivative works based on our Services

14.3 Feedback

If you provide suggestions, ideas, or feedback, you grant us the right to use them without compensation or attribution.

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Curious Kids.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

16.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or affiliate.

16.5 Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or technical failures.
